A North East La Penitence resident accused of stabbing to death a man he believed was having a relationship with his wife, whom he also injured during his rampage, was set free by Magistrate Gordon Gilhuys on Thursday but was rearrested several hours later and recharged with the same offences.
Quacy Jarvis, 26, of Lot 28 Savage Street, North East La Penitence allegedly murdered Gordon Timothy on December 5, 2005. He is also accused of wounding Sandy Jarvis on the same day with the intention of murdering her.
Magistrate Gilhuys was conducting a preliminary inquiry into the murder and attempted murder charges and recently on the prosecution’s request, he issued arrest warrants for the witnesses who were not attending court.
One witness was arrested some time later and appeared before Acting Chief Magistrate Cecil Sullivan who instructed him to attend court on Thursday.
On Thursday the prosecution informed the court that the other witnesses could not be found and so it was not prepared to proceed with the case.
An application to have the case dismissed was made by Jarvis’ lawyer Basil Williams and Magistrate Gilhuys granted the request after considering the absence of witnesses and the number of adjournments in the case.
Around 2 pm on Thursday, Jarvis appeared before Acting Chief Magistrate Cecil Sullivan charged with the same offences to which he was not required to plead. He was remanded to prison and will make a next appearance on April 24 in Court Six.
