Magistrate Gordon Gilhuys yesterday ruled in favour of the attorneys representing murder accused beauty queen Carolan Lynch in deciding not to have a statement tendered into evidence at her preliminary inquiry.
Lynch has been charged with the murder of her husband, Swiss House Cambio boss Farouk Razac. The PI is taking place at Court Two of the Georgetown Magistrate’s Court.
Last Monday her defence team, Roger Yearwood and Mark Waldron, had objected to a statement which special prosecutor Hukumchand was hoping to tender through woman detective Corporal Lilian Scotland. He had argued that the statement was an ordinary one which Scotland had taken from Lynch.
Yearwood had objected stating that the statement was taken without the officer administering the caution to Lynch in accordance with the judge’s rule and as such should not be tendered.
Gilhuys ruled that he agreed with the submissions made by the defence team, that Lynch was in custody at the time and the proper thing to do was to administer the caution. He added that in fairness to Lynch he would not admit the statement into evidence.
The judge had ordered that the case be heard from day to day from October 4. Hukumchand yesterday indicated that he would not be at court next Monday since he will be at the Appeal Court.
Razac was found dead in his bedroom at his Ireng Place, Bel Air home in May.
Lynch is being represented by Nigel Hughes, Waldron and Yearwood.
The case will continue today when both Scotland and Lynch’s neighbour David Falconer will continue their testimony.
