A woman who was charged with possession of narcotics for the purpose of trafficking walked out of court a free woman after Magistrate Tejnarine Ramroop upheld no-case submissions by the defence.
It is alleged that on October 14, 2007, Margaret Persaud had in her possession 50 grammes of cannabis sativa for the purpose of trafficking.
According to reports, Persaud was travelling in a Route 63 minibus that was heading to Moleson Creek when it was stopped and searched during a police roadblock exercise at Weldaad, West Coast Berbice.
The prosecution’s case is that Persaud had the substance in a bag. Shortly before being charged Persaud was freed on another trafficking charge.
Attorney-at-law Kim Kyte-John submitted that there was no nexus to the defendant and the bag that was found in the bus. She said too that a prima facie case had not been made out.
The lawyer further submitted that the analysis report was not tendered in court and as such there was no proof that the item in the bag was cannabis sativa.
Magistrate Ramroop admonished Persaud for being in court for the second time for a similar offence and warned her to stay away from bad company.
