Minibus driver granted bail on rape charge

It is alleged that on December 23, Mark Graham of Golden Fleece, West Coast Berbice raped the female at Number Six Village.

Graham, a bus driver was remanded to prison when he made his first two appearances on January 20 and on February 1.

He was granted his pre-trial liberty yesterday following successful arguments by attorney-at-law, Joel Persid Edmond under the condition that he lodge his travel documents with the court. He was also ordered not to be around the home of victim.

The prosecutor asked for bail to be refused on the grounds that Graham is likely to tamper with the witness and is expected to be charged with another similar offence.

The prosecutor also told the court that the defendant had a number of previous traffic charges and arrest warrants had to be issued for him and if granted bail he would not attend his trial.

In response, Edmond argued that the traffic offences are a deliberate attempt to bias the court in the refusal of bail. He said the man missed his court date and that should not be a condition for bail not to be granted.

He argued that the condition is not whether he would attend his trial but rather if he is a flight risk, submitting that his client is not the holder of a passport. The case comes up again in two weeks.
