Maxwell Thom was yesterday sent on his own recognizance after answering an assault charge before acting Chief Magistrate Priya Sewnarine-Beharry at the Georgetown Magistrates’ Court.
It is alleged that on October 8 at 1606 Cadet Lane, South Ruimveldt, Georgetown, Thom of the same address unlawfully assaulted Shelly Thom so as to cause her actual bodily harm.
The 42-year-old Thom pleaded not guilty to the charge of assault occasioning actual bodily harm when it was read to him by the acting chief magistrate.
Attorney-at-Law Anil Nandlall who represented the accused told the court that the parties had come to a decision to have the issue resolved out of court.
The magistrate cautioned the lawyer, however, that she needed to read the charge before her irrespective of the steps the parties involved were planning to take.
Nandlall then made an application for his client to be granted self-bail on the grounds that he has no previous convictions, has a fixed address, poses no risk of flight and has been cooperating with the police in their investigations.
When asked by the magistrate to relate the facts of the case, the prosecution who apologized for not having the file told the court that there was no objection to the bail application made by the lawyer.
The virtual complainant was not in court.
