Suresh Mohabir, called ‘Dicky,’ was yesterday found not guilty of the 2006 murder of a Mon Repos, East Coast Demerara man, after almost three hours of deliberations by a 12-member jury at the High Court.
Mohabir’s father, Ramnarine Mohabir, who shared a joint charge with him, was freed last Wednesday.
On July 10, Saheed Mohammed, called ‘Zico,’ was struck three times on the head with a piece of wood. The father and son (both butchers) were arrested while Mohammed was admitted to the Georgetown Hospital. He succumbed to his injuries in the Intensive Care Unit one month later. He had never regained consciousness.
The younger Mohabir, 31, walked out of the courtroom a free man last evening. Earlier, the jury deliberated for some two and a half hours before returning to the court to seek guidance on the difference between murder and manslaughter.
After a further half an hour of deliberations, the jury returned with a unanimous verdict of not guilty to murder and a 10 to two verdict of not guilty to manslaughter.
Prosecutors Judith Gildharie-Mursalin and Konyo Sandiford lead the State’s case while Senior Counsel Bernard De Santos represented Mohabir. The case was tried before Justice Winston Patterson.
Following the verdict, Gildharie-Mursalin, in keeping with the Court of Appeal (Amendment) Act of 2010, said that the State is serving a written and an oral notice of its intention to appeal.
This is the first time that the Chambers of the Director of Public Prosecutions (DPP) will be utilising the Act.
