Acting Chief Magistrate Priya Sewnarine-Beharry set the PI into the matter against Dexter Marshall who stands accused of murdering Mark ‘Lil Mark’ Caesar, for March 28 after it had twice been postponed.
When the matter was called on Friday, Prosecutor Stephen Telford told the court that the prosecution now had the file in its possession and it was ready to start the preliminary inquiry (PI) at any date convenient to the court. When the matter was called on November 29, the prosecution had told the court that the file could not be found.
Marshall’s attorney Hukumchand made an application for the prosecution to disclose all statements of witnesses that do not pose a threat to the matter, arguing that the defence is entitled to properly prepare itself. He added that the disclosure is needed for transparency in dispensing justice. Hukumchand said that at the start of the PI, he will lay over his legal submissions regarding this issue.
The allegation against Marshall is that on October 1, 2010 at Charlestown, Georgetown, he murdered Caesar. He was not required to enter a plea to the capital offence of murder when it was read to him by the acting chief magistrate. Marshall is the brother of Steve Jupiter who was one of five persons killed in a Cummings Lodge shooting in September.
