Judge entered Nolle Prosequi order in case against Guyanese Taekwondo instructor charged with sexual assault in Georgia

On November 14, 2014, a judge entered a Nolle Prosequi order (a formal notice of abandonment by the prosecutor) in the case of a  Guyanese Taekwondo instructor who had  been accused of sexually assaulting a nine-year-old girl in Georgia, USA.

According to the Atlanta Journal-Constitution, in June of 2011, it was alleged that Adrian Spellen, 28, assaulted the girl at his Taekwondo school, Powerkicks Martial Arts on 3026 Miller Road in Lithonia.

Spellen was taken into custody on June 25.

According to court documents seen by Stabroek News, on November 14, 2014, Judge Clarence F Seeliger of the DeKalb County Superior Court entered the Nolle Prosequi order for the following reason.

“This case was tried two times and both trials resulted in a hung jury. Although the State believes that incidents occurred between the defendant and victim, based on the prior trial outcomes we believe that we are unable to prove the case beyond a reasonable doubt. The victim’s family was made aware of the State’s decision regarding the case”.

Spellen has since applied successfully for an expungement of the record.
