A fisherman who is alleged to have used threatening behaviour to a man with whom he had a prior matter in court was on Wednesday remanded to prison, after he was arraigned at the Sparendaam Magistrates’ Court.
It is alleged that on November 26, in Sophia, Kevin Tappin, 21, of Lot 3001 ‘B’ Field Sophia, used threatening behaviour to Jamal Alert, whereby a breach of the peace was occasioned.
Tappin pleaded not guilty to the offence.
Facts from the prosecution stated that on the day in question, Tappin approached Alert and asked him if he wanted problems.
Prosecutor George Ali stated that Alert was proceeding to his work place when Tappin began pelting bricks at him.
Ali further stated that Tappin had appeared before the court previously following a complaint filed by Alert that he had damaged an article which belonged to Alert and was granted three months to compensate the VC.
He related to the court that the three months expired and no money was paid to Alert. Tappin had also been warned not to go anywhere near Alert’s premises.
Magistrate Alex Moore then said that Tappin had previously told him he would need a month and a half to complete a $40,000 payment which would have been compensation to Alert. However, he gave him three months to complete the payment but “not a red note” was given to Alert.
Magistrate Moore then said that assessing the situation, it would appear that Tappin had no intention to pay Alert the compensation.
When given the opportunity to speak, Tappin said he was a seaman and had not yet gone to sea to work and as such was unable to pay the compensation. He added that there was still time left as the agreement will come to an end on December 12.
Ali objected to bail. Bail was denied and Tappin will make his next court appearance on December 18 for report and fixture at the Sparendaam Magistrates’ Court.
