Justice Navindra Singh will today rule on the admissibility of a statement allegedly given by murder accused Charles Colwyn Cush, when his trial continues in the High Court.
Cush, 21 and Javon Wharton, 23, both of Mocha, Arcadia, are on trial for the murder of nine-year-old Sade Stoby between November 2 and November 4, 2007.
A voir dire (trial within a trial) was conducted yesterday on the admissibility of the statement and two witnesses, Corporal Royston Blair and Wendella Knights, the aunt of Cush, also testified.
On Monday, Stoby’s father, Eric Stoby, testified via audio/video link from the US and recounted the events of November 4, when he found his daughter’s body in a trench.
He told the court that on November 4, he left his home early in the morning and went to the Sixth Field Bridge, where he detected a foul odour.
He added that upon following the odour and the imaginary calls of his daughter, he subsequently found her body in a drain with her uniform pulled up to her waist. She was not wearing any underwear.
Senior State Counsel Judith Gildharie-Mursalin is leading the state’s case while attorney George Thomas is representing Cush and attorney Raymond Ali is representing Wharton.
