Four persons, who the police alleged had an unlicensed revolver and ammunition in their vehicle in July last year, were yesterday freed of the charges after a no-case submission was upheld by a city court.
Ruel Garner, Nelson Wayne, Kevin Ashley and Roxell De Paul were cleared of the charges that on July 18th, 2015, they had in their possession a .22 revolver and 3 matching rounds.
Trial Magistrate Fabayo Azore told the court that none of the four defendants had admitted to owning the firearm and that she is unclear as to who the weapon belongs to since no one admitted to owning it. She further stated that she could not find that they had knowledge of the firearm and the ammunition, which was found in a concealed place.
It was based on these facts that a no-case submission was upheld.
When the four defendants first appeared before Chief Magistrate Ann McLennan, on July 21st, last year, it was stated that none of them was the owner of the vehicle in which the weapon and ammunition were found. The prosecution was unable to identify the owner.
