Andrew Aulder, who was charged with causing the death of another man, was yesterday sentenced to three years in jail after being found guilty.
Aulder, 58, of Lot 616 West Ruimveldt, was charged with driving his vehicle in a dangerous manner and causing the death of Dinesh Bissoon on March 6th, 2016, at the Houston Access Road.
Chief Magistrate Ann McLennan, during her ruling yesterday, told the court that she took into consideration all of the prosecution’s witnesses, including Nathaniel Prince, who knew the defendant and was also at the scene when the accident occurred.
In examining all the evidence, the court heard that Prince’s evidence was deemed clear and credible in relation to what exactly took place on the day of the accident.
It was upon these grounds that the Chief Magistrate found that Aulder’s driving fell way below the standards of a careful driver.
She said that the defendant’s evidence was not logical after she examined the prosecution’s case in its totality. As it relates to deceased, it was noted that on March 6th, 2016, he left home in perfect health, received no other injuries after the accident occurred, underwent surgery as a result of the accident and was discharged. He was under constant eye of his father afterward since he was being medicated. However, on March 23rd, 2016, Bissoon was taken to the hospital, where he succumbed.
It was upon these bases that Chief Magistrate McLennan presented a guilty verdict.
Attorney Patrice Henry, who represented Aulder, requested that his client be granted a non-custodial sentence and added that he had no difficulty if the court requested a probation report.
Aulder, however, was sentenced to three years in jail.
