A city court yesterday ruled that a prima facie case has been made out against minibus driver Sewkumar Singh, who is charged with causing the death of the 66-year-old cyclist with whom he collided along the Herstelling Public Road in September.
It is alleged that Singh, on September 19, at Herstelling, drove minibus BLL 3749 in a manner dangerous to the public, thereby causing the death of Basil Rambarran.
Chief Magistrate Ann McLennan told Singh yesterday that based on the evidence led by the prosecutor’s witnesses, she was of the opinion that a prima facie case was made out against him.
In doing so, the magistrate overruled a no-case submission that was made by Singh’s attorney.
As a result, Singh’s attorney requested a further date to have his client lead his defence.
This request was granted by the Chief Magistrate and the matter was subsequently adjourned until December 11.
The police previously reported that Rambarran, who was on a cycle, allegedly rode across the eastern carriageway of the Herstelling road and collided with the front of the bus.
Rambarran, a labourer of Farm Squatting Area, fell on the road and was later rushed to the Diamond Hospital, where he was pronounced dead on arrival.
