Charged in September with escaping lawful custody while under investigation for rape and murder, a man yesterday had the charge against him dismissed after the magistrate upheld a no-case submission.
Thurston Semple was before Magistrate Dylon Bess on a charge which alleges that he on August 31, at the Agricola Police Station, while in lawful custody for rape and robbery, escaped.
Semple, 34, during his first court appearance denied the charge.
Attorney Bernard Da Silva, who represented the accused, had earlier made a no-case submission, arguing that the prosecution had failed to prove its case.
During his ruling yesterday, Magistrate Bess upheld the attorney’s no-case submission and later dismissed the matter against the defendant.
