Two weeks after being freed of an attempted murder charge, Fresh Co Supermarket manager Xinoxi Qu was yesterday back before a city court on a charge of assaulting one of his employees.
Qu denied the charge, which was read to him by Senior Magistrate Leron Daly in Georgetown.
The charge alleged that on August 19th, at Fresh Co Supermarket, he unlawfully assaulted Michelle Bangatt.
His attorney, George Thomas, explained that his client attended court after an arrest warrant was issued for him on August 23rd. Thomas, who made an application for the warrant to be recalled, noted that the defendant and the complainant are employer and employee and that there was a proposed agreement for the matter to be settled via payment of compensation.
After some deliberation by the complainant, she agreed to being compensated by Qu. As a result, the charge was dismissed.
The accused was previously charge with the attempted murder of a customer, Gregory Sanmoogan.
However, Chief Magistrate Ann McLennan, who presided over the Preliminary Inquiry (PI) into the charge, found that the prosecutor failed to prove that the accused attempted to unlawfully kill or cause bodily harm to the complainant.
It was the prosecutor’s case that Sanmoogan unintentionally picked up a black plastic bag along with his grocery bags as he was exiting the Fresh Co Supermarket. Afterward, the defendant allegedly ran after the Sanmoogan and began to punch and kick him.
However, the magistrate found that there was no evidence to satisfy the court that he acted unlawfully. Instead, she said he was merely going to retrieve what belonged to his employer.
