Denish Nunes, 34, was yesterday sentenced to more than three years in jail and fined over $2 million after a city magistrate found him guilty of having more than three kilogrammes of cannabis in his possession for trafficking.
The charge against Nunes alleged that on June 7th, at D’Urban Street, Georgetown, he had 3.605 kilogrammes of cannabis in his possession for the purpose of trafficking.
According to the prosecution’s case, acting on information received, ranks went to the defendant’s home and searched the premises. It was stated that upon arrival at Nunes home, there was a high scent of cannabis in the air. During the subsequent search, four transparent parcels containing cannabis were found in a barrel in his room.
Chief Magistrate Ann McLennan conducted the trial in the Georgetown Magistrate’s Court One, where she handed down the sentence yesterday.
Before sentencing him, the magistrate told the court that the prosecution proved without reasonable doubt that Nunes had possession and control of the cannabis. In addition, there was sufficient evidence that Nunes was the sole occupant. To Nunes, she said, he failed to prove to the court that he did not have knowledge of the drug, hence he was found guilty of the charge.
She subsequently sentenced him to three years and nine months in prison and ordered him to pay a fine of $2,163,000.
