Rape accused Stephen McCurdy now faces a possible retrial after a jury was yesterday unable to arrive at a verdict on the indictment levelled against him.
After two hours of deliberations, the 11-member jury returned to the courtroom and reported through its foreman that a decision could not be reached.
He said that they were deadlocked and further directions would not assist in changing positions.
As a result, before telling McCurdy that he was free to go, trial judge Justice Jo-Ann Barlow informed him that he will have to await directions from the Chambers of the Director of Public Prosecutions, who will determine the way forward and whether he will be tried again.
The trial commenced with 12 jurors, but one had to be discharged.
For non-capital offences, the jury can comprise a minimum of 10 members.
The charge against McCurdy alleged that he raped a woman on November 19th, 2017.
The trial proceedings were held in-camera at the Sexual Offences Court of the Supreme Court in Geirgetown.
