Lawyer seeks dismissal of case against ex-cop in extradition proceedings

The extradition proceedings against ex-policeman Shawn Neblett were adjourned yesterday as the defendant’s attorney informed presiding magistrate Faith McGusty that he had moved to the High Court for the matter to be thrown out.

Neblett, 34, stood before Principal Magistrate McGusty in Court 5 at the Georgetown Magistrates’ Courts, where his attorney revealed that he had moved to the High Court and requested the adjournment.

Neblett faces extradition to the United States of America to face multiple cocaine trafficking charges.

Wade is seeking to have the finding that a prima facie case was made against his client thrown out by the Chief Justice.

Stacy Goodings, the attorney who represents the US in this matter, opined that the request made by the defence was but a mere delay tactic as the defence had enough time to present its case.

Neblett is wanted in the United States for conspiracy to import cocaine, importation of cocaine, conspiracy to possess cocaine with intent to distribute, and possession of cocaine with intent to distribute.

According to the indictment, which was seen by Stabroek News, between August 2015 and September 2015, in the Eastern District of New York, Neblett conspired to smuggle cocaine into the US from Guyana. It was also alleged that in August 2015, he arranged for a courier in Guyana to smuggle cocaine into the US in exchange for US$8,000.

The matter has been adjourned until April 8.
