More than two years after his conviction for murder, Dellon Henry, called `Nasty Man,’ is hoping that the Court of Appeal will allow him to file an out-of-time appeal.
A jury had convicted Henry back in June of 2018 for the murder of East Ruimveldt footballer Dexter Griffith, whom he shot in front of his (Griffith’s) ‘Warlock’ home on September 29th, 2015.
Henry was subsequently sentenced to 51 years in prison.
In his application, which comes more than two full years late for filing an appeal, the convict is seeking leave from the Guyana Court of Appeal to now appeal, against his conviction or sentence.
In accordance with the Court of Appeal Act, however, such appeals are to be filed within 14 days of conviction.
Henry’s application was filed on February 24th, 2021.
While there are sections providing for extension of time, an application has to specifically be filed for such a request, with grounds for delay and the likelihood of success of the prospective grounds of appeal.
Griffith, 36, of East Ruimveldt, Georgetown was on the roadway in the area, which is also called ‘Warlock,’ when a man approached on foot, discharged several shots at him and escaped.
He was hit about his body, including to his left thigh, face and chest, and subsequently died on arrival at the Georgetown Public Hospital.
