Dear Editor,
Given that 120 days is the legal time limit for a judge to decide a case, is the Chief Justice breaking the law by failing to deliver judgment in a judicial review case which was heard by her more than 400 days ago, on May 12, 2022?
We brought this case in the public interest because we know that flaring is dangerous. In our case we say that Esso is not allowed to flare and that the EPA acted unlawfully when it amended Esso’s permit to allow Esso to turn around and flare in return for paying fees.
If the judge disagrees with us and dismisses our case then at least we know where we stand. But until we have a decision we do not know what the law is and we cannot go to the Court of Appeal and onwards to the Caribbean Court of Justice.
We ask the Chief Justice to deliver her decision immediately, not just for our sake but for the sake of the public interest.
