AThirty-three-year old, Junior DaSilva, a Brazilian national, of Lot 23 Hadfield Street, Georgetown, appeared before acting Chief Magistrate Sherdel Isaacs-Marcus yesterday at the Georgetown Magistrate’s Court concerning the matter of his extradition to Brazil.
His first court appearance was on April 10, where he was remanded to prison by Magistrate Judy Latchman.
It was revealed that DaSilva is wanted in Brazil for aggravated theft which is equivalent to the offence of armed robbery here in Guyana.
During the proceedings, his attorney, who made an application for bail, told the magistrate that DaSilva is a Guyanese citizen and the holder of a Guyanese passport. He also owns businesses which he operates in Georgetown, and further, has no pending matters in any other court in Guyana.
The attorney also informed the magistrate that his client was arrested on April 5, after which he was held for more than 72 hours. He added that the court proceedings for the alleged offence which was
committed in Boa Vista have already commenced and that his client has been appearing virtually as recent as February 28. The court also heard that DaSilva’s next court appearance would have been on April 10, but he was in the custody of the police and so was unable to appear.
As part of the bail application, his lawyer indicated that his client will have no issue with any conditions imposed and he has already lodged his Guyanese passport with the authorities.
Prosecutor Mandel Moore in his rebuttal told the magistrate that an Interpol Red Notice is out for the defendant and that he has not been appearing for his court dates at all in relation to the matter in Boa Vista and that the prosecution believes him to be flight risk.
Moore cited Section 15:3 of the Bail Act which states that the court can allow for detention up to 30 days in cases which involve red notices, however, the prosecution was requesting 10 days to obtain the authority to proceed and obtain the other extradition documents.
DaSilva was further remanded and the matter was adjourned to April 22.
