Judge rules for UAAW in dispute with GAWU

Sitting in the Constitutional and Administrative Division of the High Court, Justice Fidela Corbin-Lincoln has ruled in favour of the Union of Agricultural and Allied Workers (UAAW) in relation to a contested trade union recognition for Guyana Rice Development Board (GRDB) workers. 

The Guyana Agricultural and General Workers Union (GAWU) and the Trade Union Recognition and Certification Board were the respondents.

The court ruled that the Board  was required to regard the views of the applicant, UAAW  when assessing the application for union recognition at GRDB by GAWU.

The court further ruled that the Board exceeded its authority by certifying GAWU without adequately considering UAAW’s position, thereby rendering that decision null and void.

The membership survey and poll related to GAWU’s application have been annulled, the court said.

Further, the UAAW is entitled to all pertinent information and results from the survey and poll conducted by the Board, ensuring that UAAW can make informed decisions moving forward.

The Board’s approval of GAWU’s application on June 17, 2022, has also been quashed.

The UAAW was represented by Roysdale Forde SC, GAWU by Pauline Chase and the Solicitor General for the Board.
