Daniel Spellen appeared yesterday before Magistrate Faith McGusty at the Georgetown Magistrate’s Court, facing the charge of discharging a loaded firearm with intent.
According to the facts presented, on October 31, 2024, at Freeman Street, East La Penitence, Spellen discharged a loaded firearm at Kerwin Saul with intent to maim, disfigure, or disable him.
Spellen entered a not guilty plea. His attorney, Clyde Forde, told the court that the complainant, Saul, was carrying a firearm at the time. Forde claimed that Spellen tried to wrestle the weapon away from Saul, resulting in an injury to Saul’s foot.
Spellen further stated he acted out of fear for his life. Forde requested bail, emphasizing that Spellen’s job would be at risk if he were remanded.
The prosecutor opposed bail, arguing that Spellen might interfere with Saul and stressing the seriousness of the charge. In response, Forde contended that the incident involved a confrontation between both men and was not a one-sided attack.
After considering the arguments, Magistrate McGusty granted bail to Spellen in the sum of $200,000, with the condition that he report daily to the East La Penitence police station. The case was adjourned to November 27, 2024.
